Where can a foreign buyer own property?
Dubai permits foreign ownership in designated areas. The UAE Government describes three possible interests in those areas: freehold ownership, usufruct and leasehold rights for up to 99 years. They are not interchangeable.
Freehold ownership is a registered property right with no fixed end date, held over the exact plot or unit named in the record, and available in the Dubai areas designated for foreign ownership. A usufruct or leasehold right instead grants use for a registered term of up to 99 years and ends when that term expires, so the holder’s position is time-limited rather than perpetual.
Start with the exact plot or unit, not the community name alone. DLD’s Property Status service explains whether a property is freehold and therefore available to all nationalities. A mixed district, a project name or an agent’s description is not a substitute for that record.
The broader Dubai property buying hub can help place this eligibility check in the full acquisition sequence.
| Question | Evidence to request | Why it matters |
|---|---|---|
| Is foreign ownership allowed? | DLD property-status result for the exact property | Confirms whether the nationality restriction permits the transaction |
| What right is offered? | Draft contract and registry description | Distinguishes freehold from usufruct or leasehold |
| Who can transfer it? | Verified title deed or registered developer record | Connects the seller to the registered asset or project |
| How will it be registered? | Written transfer steps and required documents | Prevents payment from being separated from the registry process |

What should be checked before paying?
First, match the unit identifier, owner or developer legal name, and property status across the official record and contract. For a resale, DLD provides a title-deed verification service. For a new project, use the developer and project records rather than relying on a brand name.
Second, read the right being transferred, the payment conditions, refund terms, completion or transfer obligations, and every named fee. A valid passport is among the documents DLD lists for a non-resident foreigner using its sale-registration service, but the complete file depends on the transaction.
Third, budget the transfer independently. The complete Dubai buying-cost guide separates public registration charges from commercial and recurring costs.

Does the choice between off-plan and ready change the rule?
The foreign-ownership test still begins with the registered property status, but the evidence differs. A ready-property buyer can inspect the completed unit and verify the existing title. An off-plan buyer instead needs to verify the registered developer, project status, interim registration and project escrow arrangements.
Use the off-plan versus ready comparison to assess timing and liquidity. If the selected unit is still being built, complete the developer, project and escrow verification before reservation.
Before signing or transferring funds, obtain the current DLD record for the property, reconcile it to the contract, and use appropriately licensed legal, tax and finance advisers where the buyer’s circumstances require them.

Frequently asked questions
Can a non-resident buy property in Dubai?
Yes, a non-resident foreign buyer may acquire property in areas designated for foreign ownership. The buyer should verify the status and right attached to the specific property in an official DLD record.
Does a foreign buyer need a UAE residence visa first?
The UAE Government guidance distinguishes non-resident foreign buyers from expatriate residents, so residence is not a general prerequisite for ownership in a designated area. Transaction and identity requirements still apply.
Is every Dubai property available to foreign buyers?
No. Foreign ownership depends on the area and property record. DLD describes freehold property as available to all nationalities and non-freehold property as restricted, so the exact unit must be checked.
Does buying a Dubai property guarantee a residence visa?
No. Property registration and residence eligibility are separate official processes. Ownership may form part of a residence application only where the current criteria are independently satisfied.
